LAMB COUNTY COURT Orders discharging defendants

On June 28, 2021, an order that the community supervision of Derek Tovar, was terminated, since he had completed all of the supervision period, with all condictions of Community Supervision having been satisfacorily fulfilled. He was discharged from community supervision.

On July 14, 2021, an order was requested by the County/District Attorney of Lamb County, to dismiss the case against Jacob Escalona, on the grounds that the defendant has paid full restitution.

It was ordered, adjudged and decreed by the Court that the case against Jacob Escalona, be discharged.

On July 19, 2021, the Lamb County Judge heard and considered a motion of the County Attorney to dismiss the case against Jennifer Terri Marquez, who has satsifactorily completed the conditions of probation and has paid in full all fines, court costs, attorney fees, restitution and probation fees ordered by the court in that case.

It was ordered, adjudged and decreed by the court that the case be dismissed, and the defendant, Jennifer Terri Marquez be discharged.

On July 14, 2021, a request from the County/District Attorney of Lamb County, for the court to dismiss the case against Eusebio Duran, on the grounds that the defendant has served adequate jail time and his charge is not subject to enhancement.

It was ordered, adjudged and decreed by the court that the case be dismissed, and the defendant, Eusebi Duran, be discharged. Waivers of jury trials

On July 6, 2021, Maximo Jesus Martinez entered a guilty plea to the charge of Driving While Intoxicated BAC>=0.15, that occurred March 14, 2021.

In exchange for the defendant’s plea, the state recommended that the defendant be assessed punishment, fines, cost, restitution and findings as indicated. He was found by the court to be guilty, and was sentenced to 60 days in the Lamb County Jail, which was suspended. Instead, the defendant was placed on community supervision for two years. He must pay a $500 fine, and $596.38 of restitution and $482.10 for court costs.

On Juily 14, 2021, William Quaylel Taylor entered a guilty plea to the charge of Assault Causes Bodily Injuries that occurred Nov. 26, 2018.

In exchange for the defendant’s plea, the state recommended that he be assessed punishment, fines, cost, restitution and findings as indicated. The court found him to be guilty, and was sentenced to 45 days in the Lamb County Jail, which was suspended. The defendant was placed on community superivsion for six months. He must also pay $307 for court costs.

On July 14, 2021, Augustine Elizondo entered a guilty plea to the charge of Assault Causes Bodily Injury, that occurred on May 23, 2021.

In exchange for the defendant’s plea, the state recommended that he be assessed punishment, fines, cost, findings and restitution as indicated. The court found him to be guilty, and he was sentenced to three days in the Lamb County Jail, and ordered to pay a $500 fine, and $307 for court costs.

On July 15, 2021, Michael Tony Aguilar entered a guilty plea to a second charge of Driving While Intoxicated, which occurred May, 26, 2020.

In exchange for his guilty plea, the state recommended that he be assessed punishment, fines, costs, restitution, and findings as indicated. The court found him to be guilty, and sentenced him to 180 days in the Lamb County Jail. The sentence of confinement was suspended, and the defendant was placed on Community Supervision for two years.

He is also to pay a $750 fine, $1,060 in restitution, and $472.10 for court costs.

154TH DISTRICT COURT Revoking Community Supervision

Two cases against Esther Hernandez came before District Judge Felix Klein on Wednesday, June 23, 2021, when her two community supervision cases were revoked.

The first was a second degree felony charge of Aggravated Asssault With a Deadly Weapon that occurred Oct. 3, 2014 and she was sentenced to eight years in the Institutional Division of Texas Department of Criminal Justice, that was probated eight years with a fine.

The second is a third-degree felony charge for Hindering Apprehension or Prosecution for a Known Felon, that occurred Dec. 12, 2017. She was sentenced then to 10 years in the Institutional Division of Texas Department of Criminal Justice, that was probated to 10 years and a fine.

With her community supervision revoked, she is sentenced to serve five years in the Texas Department of Criminal Justice Institutional Division, which is to run concurrently with the case mentioned above, beginning June 23, 2021.

The next case was against Adrian Martinez, who was ordered to do Community Supervision, after being convicted on Aug 31, 2018 of Tampering and Fabricating Physical Evidence With Intent to Impair, a third degree felony.

After Community Supervision was revoked, he was sentenced to five years in the Texas Department of Criminal Justice Institutional Division, beginning June 24, 2021.

A Waiver of Jury Trial case was brought before the District Judge on Monday, June 21, 2021 against Jeffery Scott Estrada, who was charged by indictment and convicted of manufacturing and Delivering Controlled Substance PG 1 .200 G >400 G Lesser Included Offense, that occurred April 1, 2014.

After being found guilty, Jeffery Scott Estrada was sentenced to 12.5 Years in Texas Department of Criminal Justice’s Correctional Institutions Division, starting June 21, 2021.

Conviction By Jury

Robert Burns McCall, also known as “Robert Maize”, was tried and found guilty by a Lamb County Jury in the 154 th District Court, July 19 thru 21, of the offense of Violating a court-ordered Civil Commitment Requirement.

He pleaded Not Guilty to the Indictment charge of Civil Commitment Requirement, a thirddegree felony charge that occurred on Oct. 15, 2018, but was found to be guilty by the Jury following a trial on Wednesday, July 21, 2021.

He was sentenced by the court judge that Wednesday, to serve 25 years in the Texas Department of Criminal Justice’s Correctional Institutions Division.
