LAMB COUNTY COURT

Order of Deferred Adjudication

Dec. 23, 2020: Isaac Steven Gonzales, the defendant, knowingly, intelligently, and voluntarily waived the right to representation by counsel in writing in open court, when he entered a guilty plea for the offense of Unlawfully Carrying a Weapon.

The state recommended that the Court find that there is evidence to substantiate a finding of guilt, but defer that finding for a period of time.

The Court ordered that no judgment be entered, and further ordered that the defendant be placed on community supervision for a period of 15 months, as long as the defendant abides by and does not violate the terms and conditions of community supervision.

He is ordered to pay $307 court costs, and was ordered to forfeit seized weapon and perscription medication to the Sudan Police Department, and the defendant is ordered NOT to have contact with victim.

MOTIONS TO DISMISS

Motions of the Lamb County/ District Attorney, that were requested of the Lamb County Court to be heard and considered for dismissal, that were heard by the Court, and ordered, adjudged and decreed by the Lamb County Court, to be dismissed, and defendants to be discharged, were:

Nov. 10, 2020: Adalberto Martinez Gonzales, on grounds that the defendant’s daughter has claimed responsibility for the damages.

Nov 24, 2020: David Michael Stevenson, on grounds that it best serves the interest of justice.

Dec. 2, 2020: Larry Joe Breckner, on the grounds that the defendant has been convicted in a case.

Dec. 14, 2020: Austin Ray Escobedo, on grounds that the defendant pled guilty to other cases with punishment assessed.

Dec. 23, 2020: Isaac Steven Gonzales, on the grounds that the defendant entered a guilty plea in this case.

Dec. 31, 2020: Benito Jacobo Carrillo, on the grounds that the defendant was deported by Immigration and Customs in 2015, and has not returned to the United States.

Jan. 5, 2021: Crystal Lee Calderon, on the grounds that the state no longer wishes to pursue charges.

154th DISTRICT COURT

RevokeCommunuity Supervision

Dec. 14, 2020: Community Supervision was revoked for Austin Ray Escobedo in Judge Felix Klein’s 154th District Court of Lamb County, for the offense of Evading arrest and detention, with pervious conviction, that occurred Sept. 29, 2019.

The original community supervision order was given Oct. 29, 2019, and the original punishment assessed for the state jail felony charge, is 24 months state jail division, TDCJ probated 2 years, and a fine of $500.

The court previously suspended confinement in this case, and placed the defendanot on community supervision.

Subequently, the state filed a motion to revoke the defendant’s community supervision, and he has been given 101 days of total jail time credit. in the Lamb County Jail, and assessed a $500 fine, and $249 court costs.

Deferred Adjudication

Nov. 30, 2020: In exchange for Joshua Allen Swinney’s waiving the right to trial by jury, and entering a guilty plea to the offense of possession of controlled substance 1 G<4G, that occurred April 13, 2019, the state recommended that the court find that there is evidence to substantiate a finding of guilt, but defer that finding for a period.

The adjudication of guilt was deferrred, and the defendant was placed on Deferred Adjudication Community Supervision for two years. He is also ordered to pay a fine of $1,000, $250 for court costs, and $180 for restitution.

Dec. 14, 2020: In exchange for Austin Ray Escobedo’s waiving the right to trial by jury and entering a guilty plea to the offense of Assault on a family house member to impede breath and circulation, that occurred Oct. 1, 2020, the state recommended that the court find that there is evidence to substantiate a finding of guilt, but defer that finding for a period.

Adjudication of guilt was deferred, and the defendant was placed on Deferred Adjudication Community Supervision for seven years. He is also to pay $290 court costs. Waiver of Jury Trials

Nov. 18, 2020: A Judgment of Conviction by the 154th District Court of Lamb County was imposed on Rickey Lynn Sawyer for the offense of violation of Civil Commitment Requirement, that occurred Oct. 19, 2020.

In exchange for the defendant’s third degree felony plea, the state recommended that the defendant be assessed punishment.

He was sentenced to four years in TDCJ, Correctional Institutions Division, to begin Nov. 18, 2020. He already had 29 days of total jail time credit.

Nov. 18, 2020: A Judgment of Convicttion by the 154th District Court, and Waiver of Jury Trial was imposed on Quenton Rahsaud Joe for the offense of Failure to Comply with Sexual Official Duty to Register as sex offender in accorddance with state law.

In exchange for the defendant’s second degree felony offense plea, the state recommended that the defendant be assessed punishment.

He was sentenced to 10 years TDCJ, Correctional Institutions Division, to begin Nov. 18, 2020.

Dec. 21, 2020: In exchange for Romeo Nunez’s plea of guilt to the Class A Misdemeanor offense of Possession of Controlled Substance PG 1 <G-At-to lesser included offense, that occurreed Dec. 24, 2019, the state recommended that the defendant be assessed punishment. The court took into consideration an agreement when assessing the punishment of 241 days in the Lamb County Jail. The sentence was to begin Dec. 21, 2020.

He is also to pay $290 for court costs.
