WAIVER OF JURY TRIALS

On Friday, Feb. 25, 2022, Phillip Falcon entered a guilty plea to the offense of Assault Causes Bodily Injury, that occurred Nov. 25, 2021.

The defendant appeared in Lamb County Court without counsel and knowingly, intelligently, and voluntarily waived the right to representation by counsel in writing in open court.

Having been convicted of the offense, the Lamb County Court ordered Phillip Falcon sentenced for 60 days of confinement in the Lamb County Jail.

He is to pay the $270 court costs fee.

Also on Friday, Feb. 25, 2022, Gerrado Hernandez entered a guilty plea to the charge of Criminal Trespass, that occurred Dec. 21, 2021.

He appeared with counsel, and both parties waived the right of trial by jury and entered the guilty plea to the Criminal Trespass charge.

It appeared to the Court that Gerrado Hernandez was mentally competent to stand trial, made the plea freely and voluntarily, and was aware of the consequences of the plea. The court adjudges the defendant to be guilty of the offense, and sentenced Hernandez to 10 days in the Lamb County Jail. He is credited with 67 days towards incarceration and fines and costs.

On Tuesday, March 8, 2022, Christine Regina Cristan – Balderas, entered a guilty plea to the offense of Resisting Arrest Search or Transport, that occurred Oct. 22, 2020. She appeared with counsel.

The defendant waived the right of trial by jury and entered the guilty plea. It appeared to the Court that the defendant was mentally competent to stand trial, made the plea freely and voluntarily, and was aware of the consequences of the plea.

After the court heard the evidence, the court adjudged the defendant guilty of the offense, and ordered the defendant confined to 60 days in the Lamb County Jail, as a condition of community supervision.

The defendant was also ordered to complete 50 hours of community service, plus complete Anger Management (8-hour course), plus Complete MRT Course.

MOTIONS TO DISMISS

On Tuesday, March 8, 2022, a request from the Lamb County District Attorney’s office, that the court dismiss the criminal action against Brandon Lamar Johnson, for the reason: “it best serves the interests of justice;” and “restitution has been fully paid.”

The judge, after considering the request, ordered, adjudged and decreed that the case against Brandon Lamar Johnson, be hereby dismissed.

On Wednesday, March 16, 2022, a request from the Lamb County District Attorney’s office, that the court dismiss the criminal action against Allen Dorshea Scott, for the reason: “Plea bargain – plea on another case.”

The judge’s order of dismissal states: “The foregoing motion having been presented to me on the 16th day of March, A.D. 2022, and the same having been considered, it is, therefore Ordered, Adjudged and Decreed that the above styled and numbered case be and the same is hereby Dismissed.

DISCHARGING SUPERVISION

On Friday, March 11, 2022, a request from the District Attorney’s office about a case on Sean Matthew Polk, the judge’s response was:

“On this 11th day of March 2022, came on to be considered the matter of determining whether or not the finding heretofore entered in this cause against the defendant, Sean Matthew Polk, should be set aside and the defendant discharged from Community Supervision, and it appearing to the Court that says the defendant did, on the 11th day of March, 2020, plead Guilty to the misdemeanor offense of Driving While Intoxicated, and further proceedings having been suspended under conditions of Community Supervision for a term of two (2) years; and

“It further appearing to the Court that the defendant has completed all of the original supervision period, with all conditions of Community Supervision having been satisfactorily fulfilled;

“It is therefore ordered that the community supervision of Sean Matthew Polk, is terminated and he is discharged therefrom.”

On Wednesday, March 16, 2022, a motion from the Assistant Lamb County Attorney, requesting that the Court dismiss the case against Elida Iliana Villafranco, for the reason that the defendant successfully completed the term of probation ordered by the Court.

The Order of Dismissal on Deferred Adjudication by the Judge, reads:

“On the 16th day of March, 2022, came on to be heard and considered the motion of the Assistant County Attorney of Lamb County, to dismiss the case against Elisa Iliana Villafranco, and it appearing that such motion should be granted, it is accordingly Ordered, Adjudged, and Decreed by the court that the above styled and numbered cause be dismissed, and that the Defendant, Elisa IliaIliana Villafranco, be discharged.”
