LAMB COUNTY COURT Waivers of Jury Trials

On July 26, 2021, Joe Paul Guerrero entered a guilty plea to the second offense of Driving While Intoxicated, that occurred May 4, 2019.

In exchange for the defendant’s guilty plea, the state recommended that the defendant be assessed punishment, fines, costs, restitution and findings as indicated.

Found to be guilty by the court, he was sentenced to 30 days, beginning July, 26, 2021, in the Lamb County Jail, and is to pay a $2,000 fine, a $60 for restitution, and $482.10 for court costs.

On Aug. 2, 2021, Michael Philip Sanchez entered a guilty plea to the offense of Theft of Property >=$100<$750, that occurred Jan. 27, 2020. Found to be guilty by the court, he was sentenced to 60 days in the Lamb County Jail, beginning Aug. 26, 2021.

He is also to pay $247.07 in restitution.

On Aug. 2, 2021, Lacresa Sherman entered a guilty plea to the offense of Possession of Marijuana <2 oz, that occurred Jan. 4, 2020. Finding her guilty by the court, she was sentenced to serve one day, beginning Aug. 2, 2021, in the Lamb County Jail. She is also to pay court costs in the amont of $367.

On Aug. 3, 2021, Anthony William Miller entered a guilty plea to the offense of Assault Causes Bodily Injury to a Family Member. The court, finding him guilty, sentenced him to 30 days in the Lamb County Jail, to begin on Aug. 3, 2021. He is also to pay $522 for court costs.

On Aug. 6, 2021, Josephine Garcia entered a guilty plea to the offense of Theft of Property <$100 With Previous Conviction, that occurred April 4, 2020.

Found to be guilty by the court, the defendant was sentenced to 30 days in the Lamb County Jail, to begin Aug. 6, 2021. She is also to pay restitution in the amount of $45.26, and $532 for court costs. Motions to Dismiss

On July 28, 2021, the Lamb County Court received a request from the County/District Attorney of Lamb County, to dismiss the case against Francisca Jaramillo, on the grounds that the State has been provided video evidence that the alleged victim in this case was untruthful about these charges, as well as a separate incident involving this defendant.

Appearing that such motion should be granted, the court accordingly ordered, adjudged, and decreed that the case should be dismissed, and that the defendant, Francisca Jaramillo, be discharged.

On July 28, 2021, the Lamb County Court heard the motion of the County/District Attorney to dismiss the application to revoke community supervision in the case against Anthony G. Fabila, and it appearing that such motion should be granted, it was accordingly ordered, adjudged and decreed by the court that the application to revoke community supervision in the case be dismissed, and that the defendant, Anthony G. Fabila, be discharged.

On Aug. 11, 2021 the Lamb County Court considered the motion of the County/District Attorney, to dismiss the case against Dezerae Ornelas, on the grounds that the State no longer wishes to pursue charges.

Appearing that the motion should be granted, the court ordered, adjudged, and decreed that the case against Dezerae Ordelas be dismissed, and that the defendant, Dezerae Ornelas be discharged.

On July 30, 2021, the case against Derek Lee Evans went before the Lamb County Court, to determine whether he should be discharged from community supervision. Appearing to the court that the defendant entered a guilty plea on July 31, 2019, to the misdemeanor offense of Driving While Intoxicted BAC>=0.15, and further proceedings have been suspended under conditions of Community Supervision for a term of two years; and it further appears to the court that the defendant has completed all of the original supervision period, with all conditions of Community Supervision having been satisfactorily fulfilled, it was ordered that the community supervision of Defendant Derek Lee Evans, is terminated and he is discharged.

Order of Deferred Adjudication

On July 26, 2021, Lamb County Court ordered that no judgment be entered at this time against Juan Roberto Rios on the charge of Driving While Intoxicated, that occurred Dec. 31, 2020. The court further ordered that the defendant be placed on community supervision for two years, so long as the defendant abides by and does not violate the terms and conditions of community supervision.

The defendant is ordered to attend the Alcohol Offender Program. He is also ordered to pay a $750 fine, $732.10 for court costs, and $5,042.25 for restitution.

On Aug. 11, 2021, the court ordered that no judgment be entered in the case against Ethaniel Macias Garcia, on the charge of Possession of Marijuana <2 oz, that occurred Feb. 10, 2021.

The court ordered that the defendant be placed on community supervision for one year, as long as he abides by and does not violate the terms and conditions of community supervision. He is also to pay a $1,000 fine, and court costs in the amount of $367.
