154TH DISTRICT COURT

Cases were tried against six defendants by the District Judge from April 26 thru June 23, 2021.

On April 26, a Judgment Adjudication Gilt case against Summer Danielle McFadin, for the offense of manufacture and delivery of a controlled substance, PG 1 >=200G – Lesser, a first degree felony, that occurred Jan. 4, 2014.

In exchange for the defendant’s plea of true (guilty), the state recommended that the defendant be punished. The judge assessed confinement for five years in the TDCJ Institutional Division. The sentence is to run concurrent, with all cases, beginning April 26, 2021.

Two Waivers of Jury Trial cases came before the District Judge on two charges of Assault Family Household Member With Previous Convictions, against Tom Adam Olivarez

The two 3rd-degree Felony Offenses occurred on Nov. 29, 2019 and Sept. 2, 2020.

Olivarez pleaded true and was found to be guilty by the judge, who sentenced him to five years in TDCJ, Correctional Institutions Division beginning May 17, 2021. He was ordered to pay $1,000 in fines, and $290 for court costs on both cases.

Two Waivers of Jury Trial cases against Jonathan Lee Espinoza went before the district judge on May 24, 2021, on two State Jail Felony charges of Possession of Controlled Substance PG 1 <1G, that occurred Oct. 14, 2018 and March 10, 2021.

In exchange for Espinoza’s Plea of Guilty, the state recommended that he be assessed punishment. The judged sentenced him to 18 months in the TDCJ, Correctional Institution Division – State Jail, to begin May 24, 2021, to run concurrent with Lamb County Case, Cause No. DCR-6131-21.

Espinoza was ordered to pay $290 for court costs for both cases.

Another Waiver of Jury Trial case that went before the District Judge, was against Mark Stephen Gayer, on a 3rd degree indictment charge for Possession 0f Marijuana >5 lbs<=50 lbs, that occurred May 9, 2020.

In exchange for Gayer’s guilty plea, the state recommmended that he be assessed punishment, fines, and court costs. He was sentenced to six years in the TDCJ Correctional Institutions Division. The sentence of confinement was suspended, and the defendant was placed on community supervision for three years.

He is ordered to pay $2,000 in fines, $180 in restitution to the Texas Department of Public Safety, and $290 for court costs.

A Waiver of Jury Trial case against Andrew Lynn Woods, on a State Jail Felony Indictment charge of Burglary of a Building, went before the District Judge on Monday, June 21, 2021.

In exchange for Woods’ Guilty plea to the burglary offense that occurred Sept. 21, 2021, the state recommened that he be assessed punishment. He was sentenced to 12 months in the TDCJ, Civil Institutions Division. The sentence is to begin June 21, 2021, and is to run concurrent with Lubbock County case in the 137th District Court, Cause No. 2020-421444 UUMV. He is also to pay $290 court costs.

Wednesday, June 23, 2021, a Waiver of Jury Trial case was finalized against Marcus Quin Butler, after his guilty plea was entered to a third-degree felony indictment charge on a Civil Commitment Requirement on June 25, 2020. He was sentenced to eight years in TDCJ, Correctional Institutions Division.

He was ordered to pay $290 for court costs.

LAMB COUNTY COURT Waivers of Jury Trials

Between June 10 and June 24, 2021, the Lamb County Judge found four defendants guilty as charged, and were assessed the punishment.

On June 10, 2021, Daniel Salina Espinosa entered a guilty plea to the offense of Theft of Mail, more than 10 adresses. In exchange for Espinosa’s being found guilty by the judge, the state recommended the defendandant be assessed punishment. The judge sentenced him to 30 days in the Lamb County Jail, beginning June 10, 2021. He is also to pay $557 for court costs.

On June 11, 2021, Cesar Simental Santellano entered a guilty plea, and was found to be guilty by the judge, for the offense of Driving While Intoxicated BAC>=0.15, that occurred August 9, 2020. In exchange for Santellano’s guilty plea, the state recommended that the defendant be assessed punishment. He was sentenced to 30 days in the Lamb County Jail. The sentence of confinement was suspended, and the defendant was placed on Community Supervision for two years.

He is also to pay a general fine of $500, and a $60 trauma fine to the EMS, and $482.10 court costs.

On June 16, 2021, Elizabeth Ann Rodriguez entered a guilty plea to the charge of Assault Causes Bodily Injuries, and was found to be guilty by the judge, who assessed her punishment to 30 days in the Lamb County Jail, which was to begin June 16, 2021.

Her senence of confinement was suspended, and she was placed on community supervision for a year. She is also to pay $557 for court costs.

Also On June 16, 2021, Elizabeth Ann Rodriguez entered a second guilty plea to the charge of Terroristic Threat Causes Fear of Imminent SBI, that occurred Oct. 17, 2020. She was found to be guilty by the judge, who sentenced her to one day in the Lamb County Jail. She is also to pay $557 for court costs.

On June 24, 2021, Esther Hernandez, entered a guilty plea, and found to be guilty by the judge, to the charge of Assault Causes Bodily Injury to a Family Member, that occurred April 5, 2021. She received punishment of six months in the Lamb County Jail, beginning June 24, 2021. She is also to pay $522 for court costs.
