Commissioners approve tax abatement

Lamb Couny Commissioners conducted a 1 hour 15 minutes business meeting Monday afternoon, March 28, 2022, and took care of 15 agenda items.

Lamb County Judge James Mike DeLoach called the meeting to order at 2 p.m. in their meeting room of the Lamb County Courthouse.

He led the Pledges to the U.S. and Texas flags.

He invited public comments on any of the agenda items, but no one made any comments.

Consent Agenda Items

a) Minutes from the March 14 meeting were considered for later approval.

b) There were no budget and salary amendments and/or lineitem transfers to be considered.

c) Bills presented by the county auditor included: $97,515.67 for Lamb County; and $600,346.20 for the hospital, for a total of $697,861.87 to be ordered paid.

d) Payroll Payables presented by the county treasurer included: Lamb County payroll ending March 11, 2022 in the amount of $148,981.22; and Lamb Healthcare Center payroll ending March 12, 2022, in the amount of $177,463.51.

e) County departmental reports that were in the packets of each commissioner, were later approved with the other consent agenda items.

f) Total Donations to the Lamb County Library, in the amount of $850, to be used for the summer reading program at the Library, were also approved with the other consent agenda items.

4. Commissioners approved the American Revenue Plan Act (ARPA Lost Revenue Resolution.)

5. A temporary part-time position at the Olton Library during the summer, for 15 hours per week was approved, and the hourly salary was set.

6. Commissioners approved a notice of the Primary Runoff Election that will be held Tuesday, May 24. There will be three races (no local races) on the Republican ballot, and four races on the Democratic ballot.

7. A requet for a new copier for the District Clerk’s Office was presented by District Clerk Debbie Long. She noted that the new copier can produce readable pencil written documents from the Texas Civil Commitment Center, and is expected to cost about $11,000. They have had to print copies extra dark, in order to read them.

8. Judge DeLoach advised the commissioners that District Judge Klein has re-appointed the County Auditor, and that they also acknowledge the County Auditor’s bond. Judge Klein has also appointed two assistant auditors.

10. A public hearing was opened to receive information from the county’s tax abatement attorney, Bob Bass, and two representatives from Sunbuddie Energy LLC, regarding tax abatement.

Attorney Bass advised the commissioners that there were three things they needed to decide Monday: to pass the application of Sunbuddie Solar Energy LLC,

for the designation of a certain area of Lamb County as Re-Ivestment Zone for the purpose of Tax Abatement to be known as Lamb County Re-Investment Zone, with Sunbuddie Solar establishing the boundaries, and providing for the effective date of March 28, 2022. (The meeting date).

Other things the commissioners were to decide were: approve the application for a tax agreement; and approval of a road use agreement.

11. After Judge DeLoach closed the public hearing, a vote was taken and commissioners approved the application of Sunbuddie Solar Energy LLC, for the designation of a certain area of Lamb County as RE-Investment Zone for the purpose of Tax Abatement to be known as Lamb County Re-Investment Zone, with Sunbuddie Solar establishing the boundaries, and providing for the effective date of March 28, 2022.

12. Commissioners voted to accept an application for tax” abatement for Lamb County, to enter into a tax abatement agreement with Sunbuddie Solar Energy LLC, pursuant to the provisions of the Property Redevelopment and Tax Abatement Act, Chapter 312 of the Texas Tax Code.

* * * 13. Cindy Klein, Administrator of the Lamb County Hospital (Lamb Healthcare Center) reviewed the hospital’s financial report for the Commissioners.
